Cancellation Refund and Privacy Policy
Cancellation Refund and Privacy Policy
Effective date: 01/05/2026
Business operator: [Full legal business name], doing business as MarketAnywhere
This policy explains how MarketAnywhere handles cancellations, refunds, distribution credits, and personal information in connection with our marketing services. The order accepted by the customer identifies the services, pricing, deliverables, and schedule for that campaign.
Part One Cancellation and Refund Policy
1 Orders and acceptance
An order cannot be placed without the customer completing the required order form and affirmatively accepting the cancellation and refund terms presented with it before payment. We may require a signed proposal or additional approval for a particular project. An authorized representative placing an order for a business confirms authority to act for that business.
This policy applies to orders placed on or after its effective date for which it was disclosed and accepted. A specific term expressly agreed in the applicable order controls over a conflicting general term here, subject to mandatory law and applicable payment rules. Earlier orders remain subject to the terms applicable when they were placed.
2 No discretionary cash refunds
MarketAnywhere does not provide discretionary cash refunds for services properly performed, approved custom materials already produced, or lawful cancellation charges described below. A change of mind, a change in the customer's budget or business plans, or disappointing campaign response does not by itself entitle the customer to a refund for work properly completed under the order.
Where permitted and agreed as described below, the remedy for eligible unused prepaid service value following a customer-requested cancellation is a distribution credit. This policy does not replace a monetary refund required by applicable law, payment rules, or an express obligation in the customer's order.
3 Cancellation requests and charges
Send cancellation requests to info@marketanywhere.com with the customer's name, order or invoice number, and the services to be cancelled. Cancellation takes effect when the written request is received at that address; our acknowledgment is not a condition of its effectiveness. Keep a copy of the request. If email is unavailable, call 844-783-5937 for assistance. Any cancellation method required by applicable law remains available.
After receiving the request, we will stop avoidable future work as reasonably practicable. To the extent permitted by law and the agreed order, the customer remains responsible for services actually performed at the agreed rates, approved custom materials already produced, and documented, nonrecoverable commitments reasonably incurred for that order before cancellation took effect. These may include authorized design work, printing, campaign preparation, staffing, and third-party costs.
We will deduct avoided costs, supplier refunds, and other recoveries when calculating cancellation charges and will not charge twice for the same work or cost. A separate cancellation fee applies only if its amount or calculation was disclosed and accepted in the order and is lawful. Receipt of an advance payment does not, by itself, make the entire payment earned. We will provide a written accounting of charges and any remaining prepaid balance.
4 Distribution credits and unused balances
For a customer-requested cancellation unrelated to our failure to perform, any prepaid balance remaining after the permitted charges above will be issued as a distribution credit only if that treatment was expressly disclosed and accepted as part of the applicable order before payment and is permitted by applicable law and payment rules, or if the customer separately agrees to it in writing after cancellation. Otherwise, we will refund the remaining balance. We will not substitute a credit for a monetary refund required by law or applicable payment rules.
We will confirm each credit in writing, including its amount, eligible services, and any agreed conditions. A credit may be applied to a future eligible campaign, subject to availability and an agreed new order. Credits are not redeemable for cash except where required by law or payment rules. Any expiration date, transfer restriction, or other limitation must be disclosed and accepted and legally permitted. Cancellation does not automatically forfeit an unused balance.
A goodwill credit for completed work may be offered at our discretion. It does not change the terms of other orders. A credit already promised in an order or written resolution will be honored according to its terms.
5 Campaign scope and marketing results
The accepted order determines whether the customer is purchasing labor hours, specified quantities, particular deliverables, or a combination. For an hourly campaign, the order must identify the types of work included in billable hours, such as field distribution, preparation, supervision, or reporting. We will not redefine the purchased scope after payment. Estimates of coverage, pace, or distribution quantity are not fixed guarantees unless expressly identified as guarantees in the order.
Unless expressly promised in the order, we do not guarantee a particular number of inquiries, calls, scans, website visits, leads, appointments, sales, conversions, or any return on investment. Campaign response depends on factors beyond distribution, including the customer's offer, creative materials, market, and follow-up. Lack of response alone does not show that contracted work was not performed. This provision does not excuse failure to provide agreed services or override a specific written guarantee.
6 Artwork and custom printing
Customers are responsible for reviewing proofs and confirming text, contact details, artwork, dimensions, quantities, and other specifications before approving production. Corrections or changes requested after approval may require an agreed additional charge and a revised schedule. Customer approval of an error in the proof does not make that error a production defect.
Approved custom materials already produced generally cannot be returned for a discretionary refund. Documented, noncancelable production commitments may be included in the permitted cancellation charges. If our production does not conform to the approved specifications, we will evaluate correction, reprinting, replacement, or a monetary remedy as required by the order, applicable law, or payment rules. We will also comply with any applicable notice, delay-consent, cancellation, and refund requirements for remotely ordered merchandise.
7 Scheduling customer changes and delays
The order should state the service window and identify any fixed event date or other essential deadline. Changes requested by the customer are subject to availability and written agreement on any price or schedule adjustment. Missing approvals, materials, access information, or other customer inputs may delay the campaign and may result in documented costs covered by the accepted order.
If weather, safety conditions, access restrictions, or other circumstances affect performance, we will communicate the effect and proposed options promptly. We will obtain agreement where required before substituting services or materially changing agreed dates. A delay does not authorize an indefinite postponement or override any cancellation or refund right that applies.
8 Performance concerns and company cancellation
Please report concerns promptly to info@marketanywhere.com and identify the order, the specific promised service at issue, and any supporting information. We will review the accepted scope and relevant records, which may include approvals, communications, time records, routes, delivery photographs, and completion reports. We will evaluate supporting evidence in relation to the work and deliverables specified in the order.
Where appropriate, we may offer correction, repeat performance, replacement, or an agreed rescheduled service. If we cancel or cannot provide the promised goods or services, we will provide any refund or other remedy required by the order, applicable law, or payment rules. We will account for work already completed and costs already committed only to the extent those requirements permit. We will not force a distribution credit in place of a required monetary refund. Requests remain subject to applicable legal and payment-rule deadlines; this policy does not shorten those deadlines.
9 Payment disputes and mandatory rights
We encourage customers to contact us so that we can investigate a billing or service concern. Contacting us is not a condition of exercising rights that applicable law or payment rules protect. Customers retain available rights to dispute a charge, and we may respond with accurate order, acceptance, payment, communication, and fulfillment records.
Nothing in this policy limits a refund, cancellation, or other remedy required by applicable law, applicable card-network rules, our merchant agreement, or an express obligation to the customer. Required refunds will be processed within applicable deadlines using the original payment method unless another method is required or appropriately agreed. Correcting an erroneous or duplicate charge is not a discretionary refund.
Part Two Privacy Policy
10 Information covered by this notice
This notice describes how MarketAnywhere handles personal information in inquiries, orders, campaign fulfillment, business communications, and use of our website. Depending on the interaction, information may include names, business names, job titles, email addresses, telephone numbers, billing and delivery addresses, order details, artwork, campaign instructions, approvals, signatures, payment and transaction records, and correspondence.
Campaign records may include service locations, routes, delivery addresses, photographs, timestamps, and other completion information. Photographs can incidentally contain identifiable people or property. Website and device information is described in Section 14. We receive information from customers and their representatives, people who contact us, personnel and providers carrying out a campaign, and the technologies described in that section.
11 How we use information
We use relevant information to answer inquiries, prepare quotes, administer orders, process payments, coordinate personnel and vendors, produce materials, plan and perform campaigns, provide completion evidence, handle support requests, and resolve cancellations, refunds, credits, or disputes. We also use information for bookkeeping, legal obligations, fraud prevention, security, and reviewing and improving our campaign operations and customer support.
We may send service communications needed to administer an inquiry or order. Any promotional communications and website advertising activities are subject to the choices described below and applicable consent requirements. Accepting our order terms is not blanket consent to unrelated marketing, advertising tracking, or unrestricted use of personal information.
12 Disclosures and service providers
We disclose relevant information to personnel, contractors, printers, distribution partners, payment providers, and providers supporting functions such as website hosting, forms, electronic signatures, communications, file storage, and business administration, as needed for their work. We also provide relevant campaign records to the customer or its authorized representatives. Customer-provided information should be limited to what is needed for the campaign and supplied with any required authority or notice.
We may disclose relevant records to professional advisers, insurers, payment processors, financial institutions, or authorities when needed to obtain advice, address a payment dispute or claim, protect rights and safety, or comply with law or valid legal process. Information may also be disclosed in connection with a business transaction, subject to applicable safeguards and legal requirements. Advertising-related disclosures, if any, must be identified in Section 14.
Payment providers process payment information according to the payment method used and their applicable terms and notices. Do not send full payment-card numbers, security codes, or sensitive account credentials through ordinary email; use the approved payment channel.
13 Delivery photographs and campaign evidence
We use delivery photographs and related records for fulfillment verification, customer reporting, quality review, and dispute resolution. We limit identifying details and access to what is reasonably needed for those purposes and applicable recordkeeping requirements. Customers receiving evidence must use and share it lawfully and respect the privacy of other people.
Approval of an order does not give us unrestricted permission to publish identifiable individuals, private delivery locations, or customer materials in promotional content. Separate permission or another valid legal basis is required when applicable. A customer's acceptance cannot supply permission on behalf of unrelated residents or other people whose information appears in a photograph.
14 Website technologies advertising and choices
[Insert verified website disclosures before publication: identify cookies, analytics, advertising pixels, and similar technologies actually used; information collected; purposes; provider or recipient categories; retention periods or criteria; and available controls or opt-out links. State whether actual practices constitute a sale, sharing, or targeted advertising under applicable privacy laws. Explain the website's actual response to Do Not Track and legally recognized opt-out signals, including Global Privacy Control where applicable. Add required regional notices and rights mechanisms for laws that apply to the business.]
Browser settings may allow you to limit cookies, although doing so can affect site functions. Browser controls do not necessarily stop every collection or disclosure. Required consent choices and opt-out mechanisms must be available through the applicable website controls; acknowledging this privacy notice does not replace consent when consent is legally required.
15 Retention and security
We retain personal information for as long as reasonably needed for the purpose for which it was collected, including administering orders, demonstrating performance, resolving disputes, meeting accounting and legal obligations, and enforcing agreements. Retention depends on the type of record, the relationship, applicable deadlines, and any legal hold. When information is no longer needed, we delete it or deidentify it as appropriate, subject to lawful retention and backup processes.
We use reasonable administrative, technical, and physical safeguards appropriate to the information and its use. No electronic transmission or storage system is completely secure. A deletion request does not require us to destroy records that we are lawfully entitled or required to retain, including relevant records during an active dispute.
16 Privacy requests and communications choices
Depending on your location and the laws that apply, you may have rights to request access to, correction of, deletion of, or a copy of personal information; to restrict or object to certain processing; to withdraw applicable consent; or to opt out of certain advertising, sales, or sharing. These rights are subject to applicable conditions and exceptions.
To make a privacy request, contact info@marketanywhere.com and describe your request. You may use the subject Privacy Request to help us route it. Where appropriate or required by applicable law, we may request information reasonably necessary to verify your identity or a representative's authority. We will respond within the deadlines required by applicable law and provide reasons and appeal instructions when required. If an appeal right applies, you may submit the appeal to the same email address, optionally using the subject Privacy Appeal. We will not unlawfully discriminate against anyone for exercising privacy rights.
You may opt out of promotional emails using the unsubscribe link or by contacting us. We may still send necessary order, billing, security, and other service messages. Email marketing choices are separate from any website advertising or cookie choices described in Section 14.
17 Processing locations and third party services
[Insert the countries or regions in which the business and relevant providers actually process personal information. Explain any legally required cross-border safeguards and how information about those safeguards can be obtained.]
External websites and services may have their own privacy notices and practices. Review those notices when interacting directly with them. This notice does not waive our responsibilities for personal information that we control or for providers acting on our behalf.
18 Updates and contact information
We may update this policy and will identify the effective date of the current version. Changes to cancellation and refund terms apply prospectively to orders for which the new terms are properly disclosed and accepted. Privacy changes will be communicated, and any required consent obtained, as applicable law requires. We retain relevant prior versions for recordkeeping.
